Government Regulation in Lieu of Law of the Republic of Indonesia Number 1 of 2014 Concerning the Election of Governors, Regents and Mayors; and Government Regulation in Lieu of Law of the Republic of Indonesia Number 2 of 2014 concerning Amendments to Law Number 23 of 2014 concerning Regional Government

President Susilo Bambang Yudhoyono used his constitutional right to issue a Government Regulation in Lieu of Law (Perppu). There were two Perppu issued regarding the rejection of the direct regional elections bill which was passed by the DPR last week. First, Perppu Number 1 of 2014 concerning the Election of Governors, Regents and Mayors. Second, Perppu Number 2 of 2014 concerning Amendments to Law Number 23 of 2014 concerning Regional Government.

This was conveyed by President SBY in a press statement at the Merdeka Palace, Thursday (2/10) at 21.30 WIB. SBY is consistent in choosing direct regional elections by the people, with improvements. “I signed these two Perppu as a concrete form of my struggle together with the Indonesian people to maintain direct regional head elections,” explained President SBY.

Perppu Number 1 of 2014 also revokes Law Number 22 of 2014 concerning the Election of Governors, Regents and Mayors which regulates the indirect election of regional heads by the DPRD. Then, as a consequence of the direct stipulation of the Regional Election Perppu and to eliminate legal uncertainty in society, Perppu Number 2 of 2014 concerning Amendments to Law Number 23 of 2014 concerning Regional Government was issued. This second Perppu eliminates the DPRD’s duties and authority to elect regional heads.

The issuance of these two Perppu is a consistency of attitude and a follow-up to the President’s disapproval of the Pilkada Bill by the DPRD. The President has conveyed his attitude on many occasions. “I fully support direct local elections with notes of fundamental improvements,” the President added.

“Therefore, although I respect the decision-making process regarding the Regional Election Bill in the DPR RI, which decides on the mechanism for selecting regional heads by the DPRD, allow me to continue to strive for the upholding of people’s sovereignty and democracy from the people, by the people and for the people,” SBY confirm.

The Head of State said that his support for direct regional elections by the people is a form of consistency and thanks to all the Indonesian people who have trusted him to lead my Indonesia during these two periods. The President can understand and understand the disappointment, even anger, of the majority of Indonesian people, who feel that their basic right to participate in electing leaders in their respective regions has been revoked by indirect regional elections through the DPRD.

“As President who is directly elected by the people, of course I must pay serious attention to the aspirations of the Indonesian people. Moreover, these aspirations are in line with my own thoughts, namely, once again, the direct election of regional heads by the people with several improvements in the process so that it does not harm the people’s rights in democracy,” said SBY.

President SBY realizes that the consequence of issuing this Perppu has political risks because it requires approval in the DPR.

“But I am obliged to take this risk to emphasize the joint struggle with the people, and to save the sovereignty of the people and our democracy. Let us pray that the next process in the DPR can run smoothly, and in accordance with the aspirations of the people, resulting in the DPR’s approval of the two Perppu related to the Regional Elections directly. Once again, for the sake of realizing the people’s sovereignty and democracy that we aspire to,” said SBY ending his statement.

Accompanying the President when giving a press statement were, among others, Vice President Boediono, Coordinating Minister for Political Affairs Djoko Suyanto, Coordinating Minister for the Economy Chairul Tanjung, Coordinating Minister for People’s Welfare Agung Laksono, Cabinet Secretary Dipo Alam, Minister of Home Affairs Gamawan Fauzi, Minister of Law and Human Rights Amir Syamsudin, Attorney General Basrif Arief, Head of BIN Marciano Norman, National Police Chief General Sutarman, Deputy Minister of Foreign Affairs Dino Patti Djalal, Special Staff to the President for Political Communications Daniel Sparringa, and Presidential Spokesperson Julian Aldrin Pasha.
