ASN Bill, Pandora’s Box for Nawacita

The spirit of revising Law no. 5 of 2014 concerning the State Civil Apparatus (UU ASN) by the DPR RI, it is alleged that it will degrade the spirit of Nawacita, especially the bureaucratic reform that is currently being proposed by the DPR RI by abolishing the State Civil Apparatus Committee (KASN).

Program Manager of the Regional Research and Information Center (PATTIRO), Wawanudin, said that the presence of KASN is needed to improve ASN management, because KASN is a forum for the community to be able to control the bureaucratic management process. Without it, good bureaucracy is just a delusion.

“KASN is here to strengthen bureaucratic reform and improve ASN management, namely the merit system, increasing competence, neutrality, upholding basic values and the ASN code of ethics,” explained Wawan.

According to him, Wawan sees that the DPR’s initiative to eliminate KASN is only a political interest to be able to regulate officials according to taste. It is suspected that the existence of KASN has narrowed the space for political officials to politicize the bureaucracy.

“And that means, we will find more cases of buying and selling positions,” he explained.

The continuing impact of the loss of KASN, continued Wawan, is poor public services because officials are elected not based on quality but based on the tastes of regional leaders. Apart from that, elected officials are also without supervision in carrying out public services.

PATTIRO researcher, Rohidin Sudarno added, the dissolution of KASN by the DPR was very inappropriate, because the law that regulates it itself has not been completed at the Government Regulation (PP) stage which is a derivative of it, only one of the nine planned PPs.

“Let the government implement the law first, then evaluate it, not end up revising it,” said Rohidin.

Mass Mobilization

Apart from forcing KASN to turn right, in the bill, the DPR also inserted an article for the mass appointment of honorary staff to become civil servants, on the grounds that the honorary staff have served the country for many years, whose welfare should be improved.

However, Wawan saw that this article was only a form of political content to mobilize the masses, “It was only to open the way for there to be mass encouragement, so that the bill was passed and KASN was abolished,” he said.

“So it’s not based on welfare, but purely on the interests of the elite,” he continued.

In line with Wawan, Rohidin said that the thing that must be considered is the size of the budget spent by the government when appointing hundreds of thousands of people to become civil servants.

“This could be done, but as a consequence, the APBN must be increased, approximately IDR 23 trillion,” explained Rohidin.

The reason, Rohidin suggested, is that improving the welfare of honorary workers can be implemented through a Presidential Regulation (Perpres), “Honorary workers are an important asset for the country, so don’t leave their fate up to them. “And more importantly, KASN must still exist, that is a condition for a better bureaucracy,” concluded Rohidin.
